3 Things You Should Do Before Getting A Divorce

Getting a divorce is a very big decision. This is not something that you should rush into. Recognize that getting the divorced finalized can take a good deal of time, so it is best if you can prepare as much as possible to make the process go as smoothly as possible. Here are a couple things that you should do before you get divorced so that things will be easier.  

1. Get Out Of Debt As Much As Possible

When most people think of splitting an estate they think about splitting the assets and wealth. This is a big part of getting a divorce, but it is not the only division that will happen. In addition, you will also need to split the debt that that two of you have. Some of the debts will be obvious who takes them over, like student loans. It is most likely that each of you will be in charge of your own student debt, however any debt that was accumulated during the marriage, will probably be divided down the middle.

The reason it is so important to get debt paid off, is that this could ruin your credit score and financial security. Assume that both of your names are on a credit card, but your spouse is in charge of the payments. They fail to make the payments and now your credit score reflects that. This is why it is important to get out of debt if you can.

2. Get A Personal Bank Account

Until you have the final divorce your assets will still be considered joint, especially if they are in a shared bank account. This is why you should open a separate bank account and start saving some money to care for yourself once the separation does happen. This will allow you to have the funds that you need to survive, if the divorce gets messy and your spouse is uncooperative.

3. Obtain A Legal Separation

Before either of you move out, or separate, you need to obtain a legal separation. This will protect both of you. It will legally allow both of you to have claim over your own property, still have joint custody over the children and a myriad of other things. This is why you should never leave or separate unless you have a legal separation from a divorce attorney.
